Primary Terms

Pay It Square is a service to help you collect money from friends. Pay It Square provides:

1. Tools to keep your collections organized.
2. A public collect page that provides information about your collection.
3. The ability for your payers to pay you online.

Pay It Square works with PayPal's to enable online payments. In order to facilitate collecting money using Pay It Square you must have a valid PayPal account that it in good standing. Payers who pay you online must also have or register for a PayPal account and be in good standing. You will be charged to receive payments in accordance with PayPal's "Fees for receiving purchase payments". Your use of the Pay It Square service is also bound by PayPal's Acceptable Use Policy.

Except for Pay It Square's limited role of initiating your payments from our collect page, Pay It Square is not involved in any underlying transaction between you, any other user, or any other party. Pay It Square is not a bank and does not offer banking services. Pay It Square is not responsible for chargebacks, missed payments, fraud, or any other issues related to payments.

Your collection, payers and transaction history can be accessed and displayed on the Pay It Square site. Please refer to our Privacy Policy for more information.

Pay It Square distributes a newsletter about once per calendar month. By registering or making a payment on our site, you are eligible to receive this email. If you opt-out, we will honors those requests promptly and you will won't receive any promotional material from us again (we don't like spam either).

Email Scams

"Phishing" is a scam designed to steal your personal information. If you receive a message that looks like it is from Pay It Square asking you for your personal information, do not respond. Pay It Square will never request your password, user name, credit card information or other personal information.

Ownership of Website

Pay It Square's website and all content, information, reports, materials, software, programs, design, text, images, photographs, illustrations, audio and video material, artwork, graphic material, data, database and proprietary information and all copyrightable or otherwise legally protectible elements of our website, including, without limitation, the selection, sequence, the 'look and feel' and arrangement of items, adaptations, translations and derivative works, and all trademarks, trade names, service marks, logos and icons, are the property of Pay It Square, and/or its licensors or suppliers, and are legally protected, without limitation, under federal and state, as well as applicable foreign, laws, regulations and treaties.

Children under 18 years of age

You must be at least 13 years old to use the Pay It Square website and you must use Pay It Square in accordance with applicable law. If you are at least 13 years old but less than 18 years old, you must have a parental sponsor to use the Pay It Square website.

Users who are not at least 18 years old may not settle transactions using PayPal.

Restrictions

Other than for purposes related to your permitted use of the Pay It Square services, you may not download, retransmit or reproduce anything available or obtained from the Pay It Square website in any manner or in any form. You will not alter, erase or otherwise obscure any proprietary rights or other notices which appear on the Pay It Square website.

You agree not to use Pay It Square for any purposes other than to use Pay It Square's services in accordance with these terms and conditions. You are solely responsible and liable for anything you provide, enter or transmit using Pay It Square. Any unauthorized or prohibited use, including a violation of the terms of these terms of use, may subject you to civil liability or criminal prosecution, or both, under applicable laws and regulations.

Disclaimer; Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, PAY IT SQUARE AND ITS THIRD-PARTY PARTNERS AND SUPPLIERS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. YOU EXPRESSLY AGREE THAT YOUR USE OF THE PAY IT SQUARE SERVICE IS AT YOUR SOLE RISK. THE PAY IT SQUARE SERVICE AND ANY DATA OR INFORMATION MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE PAY IT SQUARE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE," "WITH ALL FAULTS" BASIS AND WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND EITHER EXPRESS OR IMPLIED. PAY IT SQUARE AND ITS THIRD PARTY SUPPLIERS AND PARTNERS DO NOT WARRANT THAT THE DATA, FUNCTIONS, OR ANY OTHER INFORMATION OFFERED ON OR THROUGH THE PAY IT SQUARE SERVICE OR ANY REFERENCE SITES WILL BE UNINTERRUPTED, OR FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS AND DO NOT WARRANT THAT ANY OF THE FOREGOING WILL BE CORRECTED. PAY IT SQUARE AND ITS THIRD PARTY SUPPLIERS AND PARTNERS DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE PAY IT SQUARE SERVICE OR ANY REFERENCE SITES IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PAY IT SQUARE, NOR ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, SUPPLIERS, AGENTS OR REPRESENTATIVES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY OTHER FORM OF DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PAY IT SQUARE SERVICES, THE WEBSITE OR YOUR USE OF THE WEBSITE, REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM AND WHETHER OR NOT PAY IT SQUARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
